2. Services Description

CAG logistics is a U.S.-based provider of domestic and international freight forwarding, warehousing, transportation, and supply chain solutions. All Services are subject to applicable federal and state laws, and industry-specific regulations, including U.S. Department of Transportation (DOT) and Federal Motor Carrier Safety Administration (FMCSA) standards.

3. Eligibility

You must be 18 years of age or older and capable of entering into legally binding agreements under applicable law. If using our Services on behalf of a business, you warrant that you have the authority to bind the business to these Terms.

5. Pricing, Payment, and Taxes

Unless otherwise agreed in writing, prices are quoted in U.S. dollars. Payment terms will be as stated on the invoice, and overdue accounts may incur interest at a rate not exceeding the maximum rate permitted under applicable law.

You are responsible for all applicable federal, state, and local taxes, duties, and surcharges unless proof of tax-exempt status is provided.

6. Limitation of Liability

CAG logistics shall not be liable for any indirect, incidental, punitive, or consequential damages. For cargo claims, liability is limited under the Carmack Amendment (49 U.S.C. § 14706) for domestic ground transportation, and under applicable international conventions (e.g., CMR, Hague-Visby, Montreal Convention) for global transport, unless a declared value is agreed in advance.

Claims must be submitted in writing within the timelines defined by the governing laws and regulations (e.g., within 9 months of delivery for domestic shipments).

7. Prohibited Use and Compliance

You agree not to use our Services to:

  • Ship hazardous, illegal, or contraband items.
  • Violate U.S. export control regulations (e.g., ITAR, EAR).
  • Breach third-party rights or engage in fraudulent activities.

You must comply with all applicable laws and regulations, including but not limited to:

  • U.S. Customs and Border Protection (CBP) rules.
  • Transportation Security Administration (TSA) mandates.
  • FMCSA and DOT requirements.

8. Intellectual Property

All intellectual property associated with our Services, including but not limited to trademarks, service marks, logos, text, software, and design, remains the property of CAG logistics or its licensors. You may not use or replicate this material without express written permission.

9. Data Privacy and Security

Any dispute arising under these Terms shall be resolved by:

  • First, good faith negotiation.
  • If unresolved, binding arbitration in accordance with the rules of the American Arbitration Association (AAA), to be held in Sarver, PA.

Each party waives its right to a jury trial in any judicial proceeding arising out of these Terms.

12. Changes to Terms

CAG logistics reserves the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our Services constitutes acceptance of the revised Terms.
